Successful Debt Recovery Court Case

The Problem

The client and the counterparty entered into an agreement for the supply of spare parts. Under the agreement, the client supplied goods and provided services with a total value of UZS 500,000,000.

However, the counterparty failed to fully perform its contractual obligations, resulting in an outstanding debt of UZS 300,000,000.

In an effort to resolve the dispute amicably and obtain voluntary repayment, a formal demand letter was sent to the counterparty. Despite this, no response was received and the outstanding debt remained unpaid.

Legal Action Taken

To protect the client's interests, the necessary legal measures were taken to recover the outstanding debt.

A claim was filed with the court seeking recovery of:

  • the principal debt;
  • contractual penalties;
  • damages incurred.

During the court proceedings, the necessary evidence was presented confirming the client's proper performance of its contractual obligations, the delivery of goods and provision of services, as well as the existence of the outstanding debt.

Result

Following the court proceedings, the court issued a decision ordering the defendant to pay a total of UZS 340,000,000, including:

UZS 300,000,000 — principal debt
UZS 30,000,000 — contractual penalty
UZS 10,000,000 — damages

As a result, the client's property interests were successfully protected and recovery of the debt arising from the counterparty's failure to fulfil its contractual obligations was secured.

🚗 One car — two liable parties.

According to a review of judicial practice, a father failed to include his son in the restricted motor insurance policy as an authorized driver.

Nevertheless, the son drove the car and caused a road traffic accident.

💰 As a result, the insurance company paid the injured party UZS 65,624,941 and subsequently filed a claim in court to recover the amount paid through subrogation/regress.

⚖️ What did the court decide?

The Judicial Collegium of the Supreme Court of the Republic of Uzbekistan concluded that the owner of a source of increased danger — the father — may also be liable for damage caused by the vehicle if it was handed over to another person with the owner's consent.

📌 Accordingly, the insurance compensation paid is subject to recovery jointly and severally from the driver and the vehicle owner through a recourse claim.

🔎 Key takeaway:

Where an insurance policy restricts the list of authorized drivers, allowing another person to drive the vehicle may lead to serious financial consequences for both the driver and the vehicle owner.

💡 Check who is listed on the insurance policy before allowing someone else to drive your car!
